2. Scope and applicable law

2.1 These Terms apply to orders placed on www.woklove.com. A “consumer” is a natural person acting for purposes outside their trade, business, craft or profession. The consumer withdrawal and consumer guarantee provisions apply to consumers. Business purchasers retain the rights available to them under applicable law, but do not have the statutory consumer right to withdraw simply because they change their mind.

2.2 The contract language is English. Contracts are concluded electronically. We retain order and invoice records in accordance with applicable legal requirements. The contract is not separately registered as a signed written agreement. No voluntary code of conduct forms part of these Terms.

2.3 Hungarian law governs the contract, including Act V of 2013 on the Civil Code, Act CVIII of 2001 on electronic commerce, Act CLV of 1997 on consumer protection, Government Decree 45/2014 (II. 26.) on consumer contracts, and Government Decree 373/2021 (VI. 30.) on consumer sales of goods, as amended.

2.4 If you are a consumer habitually resident in another country, this choice of Hungarian law does not deprive you of the protection of mandatory provisions of the law of that country where those provisions apply under Article 6 of Regulation (EC) No 593/2008 (Rome I). Any longer mandatory guarantee periods, more favourable evidential rules or additional remedies applicable to you remain available.

2.5 These Terms do not restrict mandatory consumer rights. Changes apply only to contracts concluded after the revised version takes effect and do not change existing orders. You may download, save or print these Terms for your records.

3. Products prices and payment

3.1 We sell woks, cookware accessories and other goods shown in our online shop. The product page sets out the goods’ main characteristics, including dimensions, materials, seasoning status and any stated compatibility. Handcrafted products may have minor variations consistent with their description. Images do not override the agreed description or your right to receive conforming goods.

3.2 Prices are shown in euros unless another currency is expressly displayed. Consumer prices include applicable VAT. Where the destination affects VAT, the price applicable to the delivery destination is shown before the order is submitted. Delivery charges and any other applicable charges are disclosed before you place your order. No optional extra is added without your express agreement.

3.3 The total payable and transaction currency appear in the final order summary. A bank or payment provider may apply its own currency conversion or account charges. We do not impose an undisclosed payment surcharge. Promotional conditions and periods are shown with the offer; any advertised price reduction is subject to applicable rules on the prior price.

3.4 If we identify an obvious pricing or description error before accepting an order, we will explain it and offer you the choice of ordering on the corrected terms or cancelling without charge. We will not substitute a higher price without your agreement. Any payment for an order we do not accept will be refunded promptly. An error does not give us an unrestricted right to cancel an already concluded contract; applicable law governs that situation.

3.5 Available payment methods are shown at checkout for your delivery country. These may include bank card payment through Barion, PayPal, and advance bank transfer. Cash on delivery is available only for delivery within Hungary where offered at checkout; any fee is shown before ordering. Goods paid for in advance are dispatched after cleared payment is received.

3.6 For bank transfers, use the payment instructions supplied for your order, the correct currency and your order number as the reference. Do not assume that a Hungarian domestic account number alone is sufficient for an international transfer.

3.7 Online card payments are handled by the selected payment provider (Paypal and Barion). We do not receive your full payment card details. Paypal security information: https://www.paypal.com/hu/digital-wallet/security-and-protection. Barion Payment Zrt. is supervised by the Hungarian National Bank; licence number H-EN-I-1064/2013. If payment fails, contact us before submitting a duplicate order. A successful payment alone is not an acceptance of an order.

4. Ordering and formation of the contract

4.1 Select the goods and quantity, add them to your basket, and proceed to checkout. Enter your contact, billing and delivery details, choose an available delivery and payment method, and review the full order summary and these Terms. You can correct input errors and remove or change items before submitting the order.

4.2 By clicking the final order button, which clearly indicates an obligation to pay, you submit an offer to purchase the goods on the displayed terms. By using that button you submit an offer to purchase the goods on the displayed terms. You must have legal capacity to enter into the contract or valid authorisation to act for the purchaser.

4.3 We acknowledge receipt of your order by email. An automated acknowledgement that merely records receipt is not acceptance. The contract is concluded when you receive our email expressly confirming acceptance of your order, or our dispatch confirmation if we have not sent an earlier acceptance. If an email expressly accepts the order, it forms the contract regardless of its title.

4.4 If the acknowledgement does not become accessible to you within 48 hours after submission, you are released from your offer or any obligation arising from the unacknowledged order under the applicable electronic commerce rules. Please check your spam folder and contact us if you are unsure about the status of an order.

4.5 Orders are normally processed on Hungarian business days between 08:00 and 13:00. Orders submitted outside those hours are normally processed on the next business day. We will inform you promptly if goods are unavailable or if the expected fulfilment date changes. Substitution or partial fulfilment requires your agreement where it changes the agreed order.

4.6 We provide confirmation of the concluded contract, these Terms and the withdrawal information on a durable medium, such as an email attachment, no later than delivery. An electronic invoice is sent to the email address supplied with the order. Contact us promptly if you notice an error in your order details.

4.7 You may request cancellation before dispatch by emailing hello@woklove.com. Consumer withdrawal rights may also be exercised before delivery. We do not charge a cancellation penalty for a valid statutory withdrawal.

5. Delivery collection and risk

5.1 Available delivery destinations, methods, restrictions, charges and estimated delivery periods are displayed before ordering. Delivery is normally by GLS. Our delivery offer does not oblige us to deliver to every address or territory. If your destination is not available at checkout, contact us before ordering; no extra delivery charge will be imposed after the contract is concluded without your agreement.

5.2 The current published standard delivery charges for the EU destinations listed below are €12.90 for Zone 1 and €16.90 for Zone 2. Any free-delivery offer or order-specific charge is displayed before ordering and forms part of the agreed order.

Zone 1: Austria, Belgium, Bulgaria, Croatia, Czechia, Germany, Luxembourg, the Netherlands, Poland, Romania, Slovenia and Slovakia.
Zone 2: Denmark, Estonia, Finland, France, Greece, Ireland, Italy, Latvia, Lithuania, Spain and Sweden.
Hungary and other available destinations: the charge displayed at checkout. Special territories and remote addresses are covered only if delivery is offered for the address entered.

5.3 Free personal collection is available at our Budapest collection address where offered at checkout. Wait for our collection-ready notification before visiting. Collection hours are those confirmed for your order.

5.4 In-stock orders (woks and wok accessories) are normally prepared within 1–3 business days. Goods obtained from a supplier (Forged knives) may require approximately 4–7 business days before dispatch.

Standard EU transport normally takes up to 5 business days after dispatch, depending on the destination. Product-specific delivery information and the period agreed for your order take precedence over general estimates.

5.5 Unless a different delivery period is expressly agreed, we deliver without undue delay and no later than 30 days after the contract is concluded. If we fail to deliver on time, you may require delivery within an additional period appropriate to the circumstances and terminate if we fail to deliver within it. No additional period is necessary where we refuse to deliver, or timely delivery is essential in the circumstances or you told us before contracting that delivery by a specified date was essential. On termination for non-delivery, we refund all sums paid without undue delay.

5.6 For consumers, risk of loss or damage passes when you or a person designated by you, other than the carrier, physically receives the goods. If you independently commission a carrier not offered by us, the statutory exception on transfer of risk applies. Ownership passes after full payment; this does not alter consumer rules on risk.

5.7 Please inspect the parcel on arrival and, where possible, record visible damage with the carrier and retain photographs. Contact us about damaged, missing or incorrect goods. Failure to inspect at the door, obtain a carrier report or mark the parcel “unchecked” does not remove your statutory rights. We remain your contact for problems with delivery arranged by us.

5.8 Give accurate delivery details and contact us promptly to correct errors. If a failed delivery is attributable to you, we will discuss redelivery and any reasonable additional cost before arranging it. Non-collection alone is not an unequivocal withdrawal notice. No automatic penalty applies, and valid consumer withdrawal rights remain available.

5.9 Goods dispatched from Hungary to an EU destination within the EU customs territory are not subject to import customs clearance as imports from a third country. For any separately agreed delivery outside that territory, applicable customs arrangements and any additional payable charges must be disclosed before the order is concluded.

6 Consumer right of withdrawal

6.1 You may withdraw from a distance sales contract within 14 days without giving any reason. The period expires 14 days after the day on which you or a third party designated by you, other than the carrier, acquires physical possession of the goods. For several goods ordered in one order and delivered separately, it runs from receipt of the last good; for goods consisting of several lots or pieces, from receipt of the last lot or piece. You may also withdraw before delivery.

6.2 You may also use the online withdrawal function available via the website link (main page, footer section) “Right of Withdrawal” during the withdrawal period. Enter your name, information identifying the contract or order, and the electronic contact address to which the acknowledgement should be sent. Submit your declaration using “Confirm withdrawal”. We acknowledge it without undue delay by email or another durable medium, including its content and the date and time of submission. This function is an additional method; email and postal withdrawal remain available.

Alternatively send an unequivocal statement to hello@woklove.com or to Horgász-Zóna Kft. / Woklove, 1033 Budapest, Szentendrei út 89–93, Hungary. You may use the model form below, but it is not compulsory. Sending your statement before the period expires is sufficient. Keep evidence of sending it. Withdrawal does not require our prior approval or a return authorisation.

6.3 Return or hand over the goods to our returns address without undue delay and no later than 14 days after notifying us of withdrawal. You meet the deadline if you send them before that period expires. You bear the direct cost of returning goods following a change of mind. This is different from the necessary return costs for a justified defective-goods claim, which we bear.

6.5 We reimburse all payments received for the withdrawn contract, including the cost of the least expensive standard delivery we offered, without undue delay and no later than 14 days after being informed of your withdrawal. We do not reimburse the additional cost of a more expensive delivery option you expressly selected. We use the original payment method unless you expressly agree otherwise, and you incur no fee for the refund.

6.6 For goods, we may withhold reimbursement until we receive them back or you supply evidence of sending them back, whichever occurs first, unless we have offered to collect them ourselves. A refund is not conditional on our accepting a discretionary return request.

6.7 You are liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Original packaging is helpful for safe return but is not a condition of statutory withdrawal. Opening packaging does not by itself remove the right.

6.8 Seasoning a wok, heating it for seasoning, cooking in it, or applying another permanent surface treatment may go beyond the handling necessary to inspect it and may cause diminished value. Any deduction must reflect the actual loss of value attributable to that handling; there is no automatic deduction or automatic loss of withdrawal rights merely because a wok has been used. A wok sold as pre-seasoned is not made personalised merely by being pre-seasoned.

6.9 Statutory exceptions apply only where their legal conditions are actually met, for example goods genuinely made to your specifications or clearly personalised. We do not treat ordinary cookware as excluded from withdrawal solely because it may come into contact with food. Any applicable exception is explained before the order is placed.

6.10 If the legally required information about withdrawal has not been provided, the withdrawal period is extended as required by law, potentially until 12 months after the end of the original period. If that information is provided within those 12 months, the period expires 14 days after receipt of it. You are not liable for diminished value where the law removes that liability because the required withdrawal information was not provided.

7 Legal guarantee of conformity

7.1 We are responsible for goods that do not conform to the contract, including the agreed description, quality, quantity, suitability, accessories and instructions, and applicable objective requirements. For new goods sold to consumers, Hungarian law generally provides a two-year period from delivery for legal conformity claims. Any longer period or more favourable mandatory protection applicable under section 2.4 remains unaffected. This legal protection is separate from any commercial warranty.

7.2 You may choose repair or replacement unless the chosen remedy is impossible or would impose disproportionate costs compared with the alternative, taking account of the circumstances. Repair or replacement is free of charge, within a reasonable time and without significant inconvenience, considering the goods and their intended purpose. Necessary transport, labour and material costs are borne by us.

7.3 You may obtain an appropriate price reduction or terminate the sales contract where the statutory conditions are met, including where repair or replacement has not been completed properly, a defect persists despite an attempted remedy, the defect is serious enough to justify an immediate remedy, or it is clear that conformity will not be restored within a reasonable time and without significant inconvenience. Termination is unavailable for a minor lack of conformity; the statutory rules on proving that a defect is minor apply.

7.4 Under Hungarian consumer sales law, a lack of conformity appearing within one year after delivery is presumed to have existed on delivery unless that presumption is incompatible with the nature of the goods or the defect. After that period the ordinary evidential rules apply. More favourable mandatory rules applicable to consumers resident elsewhere remain unaffected.

7.5 Notify us of a defect without delay after discovering it. Under Hungarian law, a notification within two months of discovery is treated as made without delay. Include your order details, a description and, if useful, photographs. An invoice or other evidence of purchase may be used. Original packaging and a separate warranty card are not conditions of a legal conformity claim.

7.6 Normal changes in a carbon-steel patina and ordinary wear are not in themselves defects. Damage actually caused by misuse, unsuitable storage, overheating or failure to follow appropriate care instructions may fall outside conformity remedies. These examples do not exclude manufacturing defects, goods that were already non-conforming on delivery, or liability for inadequate instructions. We assess the facts of each claim.

7.7 Hungarian law also provides a separate product warranty remedy against the producer or distributor for repair or replacement of defective movable goods. It generally expires two years after the producer put the product into circulation. Under this remedy, the consumer proves the defect. The producer may rely only on statutory grounds for exemption, including manufacture or marketing outside business activity, a defect not discoverable in light of scientific and technical knowledge at the time of marketing, or a defect caused by a mandatory legal requirement. You cannot obtain duplicate recovery under both remedies for the same defect. These rules do not restrict other mandatory rights.

8 Additional warranties and claim handling

8.1 A mandatory Hungarian warranty applies only to goods within the product categories covered by Government Decree 151/2003 (IX. 22.) and the legislation defining those categories, where its conditions are met. A price above HUF 10,000 alone does not bring all cookware within that scheme. We identify covered goods and provide the required product-specific information. Where applicable, the statutory period is two years for prices from HUF 10,000 up to and including HUF 250,000 and three years above HUF 250,000. The applicable statutory rules on commencement, extension during repair, documentation and mandatory replacement or refund deadlines apply in full. Any applicable mandatory protection of your country is preserved.

8.2 As an additional commercial commitment, Mammafong woks purchased from us carry a one-year warranty from delivery against defects in materials and workmanship under normal household use. The guarantor for this commitment is Horgász-Zóna Kft., at the contact and returns addresses in section 1. Contact us with evidence of purchase and a description of the defect. We repair or replace covered defective goods free of charge. This additional warranty does not cover ordinary wear or damage caused by abuse, neglect, overheating, commercial use or use contrary to appropriate instructions; harmless variations inherent in hand finishing are not covered. These limitations apply only to this extra warranty and never reduce your legal conformity rights. In particular, the one-year period does not shorten the legal guarantee described in section 7.

8.3 Any other commercial warranty is available only where expressly stated for the product or in an accompanying guarantee statement. Applicable guarantee statements are supplied on a durable medium by delivery. Advertised warranty commitments remain binding as required by law. Failure to provide a required statement does not invalidate the consumer’s warranty rights.

8.4 We record consumer conformity and warranty claims and provide a copy of the record without delay in a verifiable form. If we cannot state our position when the claim is made, we notify you of our position within five business days, including reasons for a rejection and information on conciliation. Records are retained for three years. We aim to complete repairs or replacements within 15 days; if that period is exceeded, we inform you of the expected duration. This aim does not displace a shorter binding deadline or your right to a remedy within a reasonable time.

8.5 We make the required harmonised EU notice on the legal guarantee of conformity available before purchase. Where the producer provides a qualifying free commercial guarantee of durability, we also display the required harmonised label. Available producer information on repairability, spare parts and repair services is made accessible where required by law. These notices supplement, rather than replace, your legal rights.

9 Voluntary exchanges

9.1 You may contact us to request an exchange of unused goods in new condition. A voluntary exchange is subject to agreement on availability, any price difference and delivery costs. We do not charge a separate exchange handling fee. If an item is not in new condition, we may discuss a reduced exchange credit, which applies only if you agree.

9.2 Conditions for voluntary exchanges do not limit statutory withdrawal or remedies for defective goods. If you seek a refund under a valid withdrawal, we apply section 6. If goods are faulty, we apply sections 7 and 8 and applicable law.

10 Complaints and dispute resolution

10.1 You may make a complaint by email to hello@woklove.com, by telephone at +36 20 221 8987, by post or in person at our correspondence address in section 1. Include your order details and explain the outcome you seek. We examine oral complaints immediately and remedy them where possible. If immediate investigation is not possible or you disagree with the handling, we record the complaint and our position and provide the record as required by law.

10.2 We provide a reasoned written response to a written consumer complaint within 30 days of receipt in a verifiable manner. If we reject it, we explain why and provide the legally required information about the relevant authority or alternative dispute resolution body. Complaint records and responses are retained for three years. This response period does not postpone a refund or remedy subject to a shorter deadline.

10.3 Consumers may seek out-of-court resolution through a competent Hungarian conciliation body. We cooperate with conciliation proceedings as required by Hungarian law. The body corresponding to our registered office is:

Budapesti Békéltető Testület — Budapest Conciliation Board
Address: 1016 Budapest, Krisztina krt. 99, first floor, room 111, Hungary
Postal address: 1253 Budapest, Pf. 10, Hungary
Telephone: +36 1 488 2131
Email: bekelteto.testulet@bkik.hu
Website: https://bekeltet.bkik.hu

10.4 The competent board is determined by the applicable procedural rules. Consumers may request a different Hungarian board where permitted. Contact the board for the current procedure, submission options and language arrangements. Statutory cooperation obligations and the circumstances in which a decision is binding are governed by Hungarian law; these Terms do not restrict them.

10.5 If you live in another EU country, Iceland or Norway, you may contact the European Consumer Centre in your country for free information and help with a cross-border dispute. ECC-Net assists consumers; it is not a court. Contact details: https://www.eccnet.eu/consumer-rights/how-enforce-my-consumer-rights/european-consumer-centres-network-ecc-net.

10.6 You may also contact a competent consumer protection authority or seek a judicial remedy. Nothing requires you to complete conciliation before bringing proceedings where the law permits direct access to court. Consumer jurisdiction is governed by applicable law, including Regulation (EU) No 1215/2012. Where its consumer provisions apply, you may sue in the Member State where you are domiciled or in Hungary; we may generally sue you only in the Member State where you are domiciled. These Terms do not impose exclusive Hungarian jurisdiction on consumers.

11 Privacy and other provisions

11.1 We process personal data in accordance with the GDPR and applicable law. Our separate Privacy Policy explains the purposes, legal bases, recipients, retention periods and your rights. Our Cookie Policy explains cookies and relevant choices. Acceptance of these Terms is not consent to marketing or to optional cookies.

11.2 Website content is protected by intellectual property law. You may save and print these Terms and order information and use website content for lawful personal purposes. Commercial reproduction or exploitation requires permission unless permitted by law.

11.3 We may use carriers, payment providers and other service providers to fulfil the contract. This does not remove our responsibilities to you. We remain responsible as required by law for persons used to perform our obligations.

11.4 If circumstances beyond our reasonable control affect fulfilment, we inform you promptly and explain the expected consequences. Such circumstances do not automatically remove statutory rights to delivery, termination, refunds or compensation where applicable. We do not exclude liability that cannot lawfully be excluded, including mandatory consumer and product liability.

11.5 If a provision is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. Invalid provisions are not replaced by terms that reduce mandatory consumer protection. Failure to exercise a right does not by itself waive that right.
